Overview
This policy outlines the terms regarding refunds for services and digital products offered by SystemSculpt. By making a purchase, you agree to this Refund Policy. Please read it carefully.
Consultation Sessions
- Cancellation (More than 24 hours notice): If you cancel a scheduled session with more than 24 hours' notice via email, you are eligible to reschedule the session at no additional cost, subject to availability. No monetary refunds are issued for cancellations.
- Cancellation (Less than 24 hours notice) & No-shows: Cancellations made with less than 24 hours' notice, or failure to attend a scheduled session without notice (no-show), will result in the forfeiture of the session and the associated fee. The session will be considered used, and no refund or rescheduling option will be provided.
- Completed Sessions: All consultation sessions are considered final once completed. No refunds will be issued based on satisfaction with the consultation provided.
Digital Products
All sales of digital products (such as e-books, templates, courses, or other downloadable/accessible content) are final and non-refundable once the product has been delivered or access has been granted via your account.
Due to the immediate access and intangible nature of digital goods, we do not offer refunds or exchanges for reasons including, but not limited to: change of mind, dissatisfaction with content, or accidental purchase.
- Non-Delivery/Access Failure: The only exception is if you experience a verifiable technical failure originating solely from our platform that prevents you from accessing the purchased digital product entirely. In such documented cases, please contact support within 7 days of purchase. We will first attempt to resolve the access issue. If we verify that access cannot be provided due to a fault on our end, a refund may be issued at our sole discretion. Issues related to your device, internet connection, software compatibility, or failure to read product requirements do not qualify for a refund.
Session Packages
Session packages are offered at a discounted rate based on the purchase of multiple sessions upfront.
- Refunds: Session packages are non-refundable, either in whole or in part.
- Unused Sessions: Any unused sessions remaining in a package are non-refundable and cannot be exchanged for cash or other services.
- Expiration: Session packages expire 12 months from the date of purchase. Unused sessions remaining after the expiration date are forfeited and are non-refundable.
Subscription Services
For any subscription-based access to resources or services:
- Cancellation: You may cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of your current billing period.
- No Partial Refunds: We do not provide refunds or credits for partial subscription periods or unused time within a billing cycle. You will retain access to the subscription service until your current billing period ends.
- Access Failure Exception: If you are unable to access the core subscription service for a prolonged period due *solely* to a verified technical failure on our platform, please contact support. We may, at our discretion, offer a pro-rated service credit or refund for the period of verified non-access caused by our systems.
Chargebacks and Disputes
IMPORTANT: Before initiating a chargeback, you must first attempt to resolve any issues directly with us by contacting mike@systemsculpt.com.
Initiating a chargeback for reasons disputed by this policy may result in:
- Immediate suspension or termination of your account and access to all services and products
- Being banned from future purchases
- Legal action to recover the disputed amount plus associated fees and costs
- Reporting to credit agencies and chargeback databases
- Collection proceedings
We maintain comprehensive records including access logs, IP addresses, download records, and usage data to contest invalid chargebacks. By making a purchase, you explicitly agree that initiating a chargeback without first attempting resolution directly with us constitutes a breach of contract.
Evidence and Documentation
We maintain detailed records of all transactions and service delivery, including:
- Transaction timestamps and payment confirmations
- IP addresses and device information at time of purchase
- Access logs showing successful downloads or service usage
- Email delivery confirmations
- Session attendance records
- Support ticket history
This documentation will be used to dispute any chargebacks or claims that violate this refund policy.
How to Report an Issue
To report a verifiable technical issue related to product access or delivery as outlined in the exceptions above, please email us at mike@systemsculpt.com with:
- Your name and account email address
- Purchase date and order details
- Detailed description of the technical issue preventing access
- Relevant screenshots or error messages documenting the issue
Please note that inquiries regarding dissatisfaction or change of mind will be referred back to this policy.
Refund Processing (for Approved Exceptions)
In the rare event a refund is approved based on the explicit exceptions noted above, it will typically be processed within 7-14 business days to the original payment method. Processing times may vary based on your bank or payment provider.
Lifetime Licenses and One-Time Purchases
Lifetime licenses and one-time purchase products are:
- Non-refundable under all circumstances once payment is processed
- Non-transferable to other users or accounts
- Subject to our Terms of Service and Acceptable Use Policy
- May be revoked for violations of our policies without refund
Bundle Purchases
Product bundles are sold as a single unit and:
- Cannot be partially refunded
- Cannot be broken up or individual items returned
- Are subject to the most restrictive refund terms of any included item
Free Products and Promotions
Products obtained for free, through promotions, or with discount codes:
- Are explicitly non-refundable
- Cannot be exchanged for cash or credit
- May be revoked if terms of the promotion are violated
Currency and Payment Methods
All refunds (in the rare cases where approved):
- Will be issued in the same currency as the original payment
- Will be returned to the original payment method only
- May be subject to currency conversion fees by your bank
- Do not include any payment processing fees
Legal Remedies
By making a purchase, you agree that:
- Your sole remedy for dissatisfaction is to stop using our services
- You waive any right to seek injunctive or equitable relief
- Any disputes will be resolved through binding arbitration as outlined in our Terms of Service
- You will not make any public statements disparaging our services if seeking a refund
Acknowledgment
By completing a purchase, you acknowledge that you have read, understood, and agree to be bound by this Refund Policy. You further acknowledge that you are purchasing digital products or services that are delivered immediately upon payment, and you waive any cooling-off period or right of withdrawal that might otherwise apply under consumer protection laws.
Changes to This Policy
We reserve the right to modify this Refund Policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services or purchase of products after changes are posted constitutes acceptance of those changes. However, changes will not apply retroactively to purchases made before the policy update.
Governing Law
This Refund Policy is governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from this policy shall be resolved in the courts of California.
